Gun Groups to Sue over Montana-made and Retained Firearms (for immediate release - 08/21/09) MISSOULA, MT - the Montana Shooting Sports Association (MSSA) and the Second Amendment Foundation (SAF) have formed a strategic alliance to litigate the principles of the Montana Firearms Freedom Act (MFFA), passed by the 2009 Montana Legislature and signed into law by Montana Governor Brian Schweitzer. The MFFA declares that any firearms made and retained in Montana are not subject to any federal authority, resisting Congress's dramatically expanded use of the interstate commerce clause to justify Washington's regulation of virtually all of the private economy. The MFFA also applies to firearm accessories and ammunition. MSSA is most well-known for advancing pro-gun and pro-hunting bills in the Montana Legislature, and has been successful with 54 pro-gun and pro-hunting measures in the past 25 years. SAF is a pro-gun foundation in Bellevue, Washington, established to press the rights of gun owners primarily in judicial fora. SAF has been a party to numerous lawsuits to assert the rights of gun owners across the Nation. The primary purpose of the MFFA is to set up a legal challenge to federal power under the commerce clause. MSSA and SAF expect to mount this legal challenge by filing a suit for a declaratory judgment to test the principles of the MFFA in federal court on October 1st, the day the Montana law becomes effective. The concept of the Firearms Freedom Act has caught fire nationwide. Tennessee has passed a clone of the MFFA. Other clones have been introduced in the legislatures of Alaska, Texas, Florida, South Carolina, Minnesota and Michigan. Legislators in 19 other states have indicated that they will introduce MFFA clones soon or when their legislatures next convene. MSSA president Gary Marbut commented, "We're excited to get the MFFA into court to articulate and argue the principles of freedom and states' rights. It's especially encouraging that people in so many other states are getting tickets to ride this particular freedom train. It will be an interesting journey, and we hope successful one." SAF founder Alan Gottlieb added, "This is an issue that needs public attention because it challenges federal intrusion into an area where the federal government clearly, and literally, has no business." The MSSA/SAF legal team is currently working up its arguments and litigation strategy. The team has identified several areas of rationale' that have never been discussed before in cases about Congress's commerce clause power. The general thesis is that Washington has gone way overboard in attempting to regulate the internal affairs of states under the strained theory that states' internal activities are related to interstate commerce. Although the MFFA addresses firearms, ammunition and firearm accessories specifically, it is primarily about states' rights and the commerce clause power of Congress. I typed up a long trip report of my trip to Montana this summer...Deleted it...

MONTANA HAS TEETH.

I can't even type all the things I saw, all the FREEDOM and true patriotism [i.e. duty to a set of ideals], without it sounding a little bit.... threatening

Because they are so serious.

I found them to be well informed, aware, and happier overall than any other State I have visited...or lived in.

Because they are so serious.

Sounds like a great place to live. Maybe I'll go visit next summer and scout it out. On a related note, anyone know a good place to get wool long johns? :biggrin:

They don't like people who move there out of the blue. I think they would be your kind of folks though, wildcard. You could get along out there.

Their biggest beef right now is out-of-state people keep moving in and buying up the property and trying to pass a bunch of environmental regulations...a native asked me to look around... He was right...it is PRISTINE...they don't need any help from the polluted states on how to manage land, they have been doing it for generations...I saw zero litter and zero crime while there.

It was kind of funny to be driving through a big, beautiful terrain of crops and BIG private property lines, and suddenly see some Californian suburbs! Little enclaves of rows of homes in the middle of pristine soil! New in the last few years. [****ing Californians, I was told....]

Oh yeah...they have a law on the books saying no illegal can take any job any Montana man or woman wants...They have a strict guest worker program and I saw NO racism towards these guys, who are all there legally...They're friends with them, I watched the guest workers and locals buy eachother a few beers at one location...By the way, local beers? :ok::coolbeer::ok: Brewery on the north side of flathead lake....

I asked why nobody was ****ing with me...he said it is because over there, I look like I am from the Crow nation...Brown Hair, Golden Skin, Half-white Half-egyptian guy, okay I'll buy it. Crow nation, never defeated, never surrendered, still Sovereign. Make their own license plates and drive on public roads. HAHA! That one made me belly laugh. I really saw all this.

You have to live there for a few years before you can use all of it...but their constitution guarantees you access to 'a clean and healthy lifestyle'...This means cutting down trees on public land...hunting...having truly clean water...constitutionally guaranteed...

P.S. Oh yeah, the point of this article, they're all armed! And proud of it!

I told a friend of mine (who has been here all his life) that I saw a bumper sticker that read "Montana is a nice place to visit, please don't move here".

He replied " He was probably from California".

Plaintiffs filed suit in support of the law, in federal district court, on October 1, 2009.

These plaintiffs are the Montana Shooting Sports Association, the Second Amendment Foundation, and MSSA president Gary Marbut. The legal complaint states that Marbut "wishes to manufacture and sell small arms and small arms ammunition to customers exclusively in Montana, pursuant to the MFFA, without complying with the NFA or the GCA, or other applicable federal laws."[8][9][10][11] One firearms manufacturer in Kalispell, Montana has stated that because they cannot afford to litigate, they do not plan to sell their AR-15s or AR-10/AR-15 family receivers to private parties without a Form 4473. But they did state that they intend to do so, once a court ruling clears the way.[12]

These laws can be a great way to help create some jobs, and perhaps bring in some new gun manufacturers on the state level. Being a resident of Texas, I would love to buy guns made by Texans, especially if it means getting a chances to poke the ATF in the eye at the same time.

I haven't really thought about who makes guns in Texas. I know Bond Arms does, not sure who else. Cimarron has guns imported for them, but I wonder how many parts would qualify for it being made in the state?
